A follow-up to my first blog post. People must understand that the courts can't save us from Trump, no matter how they rule because they have no enforcement power. Lower federal court rulings are complicated because no decision is final until SCOTUS rules which brings the full force of its constitutional power to interpret the Constitution. If SCOTUS rules against Trump, the first option is that Trump backs down per his constitutionally-required oath to uphold the Constitution. Crisis anverted and Trump can't be punished for his interpretation of the law.
But ignoring a SCOTUS ruling is de facto unconstitutional which brings us to the second option which is Congress' constitutionally-required oath to uphold the Constitution and its' constitutional power to impeach, convict and remove. But failure by Congress to take action does not absolve Trump. He is only getting a pass by persons in violation of their constitutional duty and oath.
The third option is that every federal executive officer (VP, Cabinet, etc.) swore a constitutionally-required oath to uphold the Constitution. Can they use the 25th Amendment and remove the President? Unknown. Would they? Doubtful. If not, they are now violating their oath.
The fourth option is that every state executive officer (Governor, Lt. Gov, State Cabinet official, etc.) and member of a state legislature swore a constitutionally-required oath to uphold the Constitution. What can they do? Use the National Guard to physically remove the President from office but the President would probably call out the federal military to prevent that.
And now we are at a 5th option. Though not required by the Constitution, every military officer swore to uphold the Constitution and failure to do so is a personal violation of their oath. To fulfill their oath requires a military coup.
FINALLY, if the military fails to take such action or SCOTUS ruled for Trump at the very start and citizens don't agree, it's either live with it or revolution.
